Investigation Into Problems Receiving Services Under The Individuals With Disabilities Education Act

Summary of Investigation: The Individuals with Disabilities Education Act (“IDEA”) contains provisions that protect the educational interests of children with disabilities. IDEA covers infants and toddlers (birth to 2 years old) and children (3 to 21 years old) with disabilities. Children with acquired brain and spinal injuries, ADD/ADHD, autism, cerebral palsy, emotional and psychological disorders (including anxiety disorder, bipolar disorder, depression, obsessive compulsive disorder (OCD), phobia, acrophobia, agoraphobia, and schizophrenia), genetic or chronic medical conditions (including cancer, diabetes, and hemophilia), hearing impairments, intellectual disabilities, learning disabilities (including dyslexia and dyscalculia), muscular dystrophy, speech and language delays (including dyspraxia), spina bifida, trisomony 21 (Down syndrome) and other developmental disabilities, and visual impairments are entitled to services under the IDEA. Under the IDEA, children with disabilities may be entitled to special education and additional educational services, such as assistive communication devices, speech therapy, Applied Behavior Analysis (ABA) therapy, specialized transportation, occupational therapy, post-secondary life-skills transition services, and psychological counseling.
